MyResearch - TERMS OF USE

MyResearch (also referred to as "the Service") is an online collaboration platform intended to assist researchers to network and collaborate by gathering information about their profiles, applications for funding, projects and related activities and documentation. The users have full control on sharing this information with entities they wish to collaborate with (colleagues, institutions and funding agencies). MyResearch staff (also referred to as "the Provider") has only the possibility to support, monitor, and administer data while respecting the confidential nature of the information provided.

When you register and use this system, it means that you understand and accept these Terms of Use as an agreement that is legally binding between the Provider and any natural or legal person who, as a recipient of the service, uses the Service for any purpose, hereafter referred to as "the User".

All information entered into MyResearch will be governed and protected in accordance with applicable privacy legislation in Canada and with these Terms of Use. Individual terms and conditions and individual amendments to all terms and conditions are only binding if concluded in written form. Also, waiving this formal requirement can only be concluded in written form.

Information provided will be transmitted to MyResearch database in an encrypted format and stored on a secure server. Secure Socket Layer (SSL) encryption technology is used to encrypt any data sent between the MyResearch system and end-users equipment.

CONFIDENTIALITY

The information collected within this system (MyResearch) will be treated with strict confidentiality. The data entered is owned by you and will not be shared without your knowledge or informed consent. Only the data you have entered will be kept. No other personal information will be added to your account without your knowledge. You have control over the updates to your data, and ultimately, the deletion of your account in the MyResearch system. Only the partners (funding agencies and institutions) to which you give consent will have access to data you submit to them. You can update your consent at any time from the "My consent" page.

Some data may be used to identify you when using the help desk or if you forget your system account or password. Such data (answers to some questions) will be used only for security and identification purposes.

CONDITIONS OF AGREEMENT

1. I declare that all the information I will provide for my registration in MyResearch will be accurate, complete and up to date. I agree to inform MyResearch immediately of any change to submitted information.
2. I agree to abide by the strictest confidentiality with respect to my password. I also agree that I am fully responsible for the security of my password and that I will take all reasonable precautions to avoid disclosure to unauthorized individuals. I will notify MyResearch immediately if I suspect that the security of my system account or password login information has been breached or if I suspect that access to MyResearch has been or may be used unlawfully or without my consent.
3. I authorize the Provider, or other authorized assignee of the Provider, (collectively 'the Provider') who is responsible for the development, administration and operation of MyResearch to collect, use and disclose the information provided for the purposes of monitoring, administering and/or supporting the system.
4. I understand that no changes will be made by MyResearch directly in any submitted information and that the information received by MyResearch will be retained in a secure manner for my current and future use. It is my responsibility to keep the information updated.
5. I authorize MyResearch to use the information collected for statistical, research and administrative purposes, to provide me with specific publications or to contact me in the future with respect to my possible participation in research related task forces, peer reviews, surveys, etc.
6. I authorize MyResearch and its partners (funding agencies and institutions) to use the information collected, including identifiable public information, for the purposes of communicating to the general public through their media formats including websites, newsletters, publications, etc. I understand that all partners sign an agreement that defines their responsibilities regarding privacy of information and the manner in which they may use the data they receive from MyResearch.
7. I agree that MyResearch and its partners (funding agencies and institutions) are not liable in any way for the subsequent use or misuse, by any member of the public, of any of my information that is published to the general public.
8. I will not use or disclose any information of others that I obtain or view in connection with my permitted access to MyResearch except for the sole purpose of my declared participation in the MyResearch system relating to my projects and data.
9. I warrant that I will not use MyResearch for any purpose that breaches confidentiality or privacy of others, is unlawful or prohibited by this subscription agreement or that in any way could damage or impair the system or interfere with any other party's use of the system. I will not obtain, or attempt to obtain, any materials or information through MyResearch that have not intentionally been made available to me.
10. I will hold MyResearch harmless for all damages, losses and costs related to all third party claims, charges, and investigations, caused by any submission of content that violates third party rights or applicable laws and any activity in which I will engage on or through MyResearch
11. I understand that MyResearch reserves the right, in its sole discretion, to terminate or restrict my access to MyResearch and the related services or any portion thereof at any time, without notice.
12. If I purchase any services offered for a fee, I agree to pay the applicable fees as they become due plus all related taxes and agree to MyResearch storing my payment card information. The obligation to pay fees continues through the date I cancel my subscription to the Services. All fees and charges are nonrefundable and there are no refunds or credits for partially used periods.
13. If I wish to close my MyResearch account, I will contact the MyResearch Help Desk.

While a translation of these Terms of Use has been provided to you with other language version, if there is any contradiction between what the English language version of the Terms says and what a translation says, then the English language version shall take precedence.

When I select "I ACCEPT" below, I confirm that I am in full acceptance of these MyResearch Terms of Use and that this electronic acceptance is equivalent to my handwritten signature. I recognize and accept that this agreement applies in full to data, documents and communications I may submit, view or obtain electronically or otherwise relating to MyResearch and its operations.
